Allahabad High Court Mandates 'Due Process' and Notice Before Encroachment Removal

The Allahabad High Court has ruled that no demolition or eviction from public land can take place without providing a formal notice to the occupants. The Court held that even if an occupation is technically an 'encroachment,' the state must follow the principles of natural justice by giving the individuals an opportunity to explain their position.
The bench observed that summary evictions often result in human rights violations, especially when they involve the destruction of dwellings in harsh weather conditions. Authorities are now required to document the service of notice and consider the feasibility of rehabilitation where applicable.
Preventing Administrative Arbitrariness
These guidelines are intended to prevent arbitrary actions by local municipal corporations and development authorities. The Court clarified that while public land must be protected, the process of reclaiming it should be transparent and legally sound.
The ruling also instructs district magistrates to ensure that the police are used only to maintain order and not to facilitate illegal evictions that bypass the established judicial or administrative procedures.
