Delhi HC Rules 'Legal Research' is Not Sufficient Cause for Condoning Delay

Strict Adherence to the Law of Limitation

In a stringent application of the Limitation Act, the Delhi High Court rejected an application to condone a delay of over a year in challenging a Sessions Court order. The petitioner, who is himself a practicing advocate, claimed the delay occurred because he needed extensive time to comprehend the legal implications of the impugned order and conduct necessary legal research.

The Court, relying on Supreme Court precedents, emphasized that while the length of the delay is secondary to the 'sufficiency of cause', the explanation provided must be cogent and cover the delay practically day-to-day. The Bench firmly stated that allowing 'legal research' as an excuse for a prolonged delay, especially from a legal professional, would entirely dilute the statutory principles of limitation.

The High Court observed that accepting such vague justifications would render limitation statutes redundant and open the floodgates for stale claims. The petition was consequently dismissed for lack of due diligence and failure to meet the threshold of sufficient cause.
